Standard Hire Terms
Our Standard Hire terms are applicable to all dry-hires of our equipment, and must be agreed to in full on delivery/collection of equipment. These terms were last updated on the 7th of December 2011 by the Senior PA Rep
- Herein, "The hirer" shall be defined as the individual making an equipment booking with PA Committee and whom will be responsible for the equipment while on hire and subsequent payment of the invoice.
- The hirer shall be responsible for any damage to equipment provided during the hire period, excluding what may be described as wear and tear such as scuff marks.
- All costs of repair or replacement of items shall be paid for in full upon request by the hirer.
- All equipment remains the property of the Junior Common Room of Van Mildert College at all times.
- In the cases of loss, damage, or theft of any items, it is the responsibility of the hirer to inform the Senior PA Rep.
- It is the financial responsibility of the hirer to pay all costs of repair or replacement of items upon request by the Senior PA Rep, where appropriate.
- All equipment will be returned clean and undamaged, ie. cables must be coiled and taped, any broken lamps replaced, otherwise a charge will be levied for repairs and lost hire revenue at the discretion of the Senior PA Rep.
- The hirer must not make any unauthorised repairs or modifications to any equipment.
- Payment for the hire shall be made by the hirer within 28 days of the issue of an invoice.
- Payment should be made via cheque made payable to Van Mildert College Committee Account or as cash
- Cheques should be posted to Gavin Birch, Tech Committee, Van Mildert College, Mill Hill Lane, Durham, DH1 3LH
- If it is necessary to pay by cash or bank transfer please contact the Senior PA Rep in advance to make arrangements for this.
- Payments not received within 28 days will incur additional charges. The standard overdue charge is currently set at 5% of the total hire cost, per week. Persistent late payees are advised that a higher overdue charges rate may be applied at the discretion of the Senior PA Rep.
- No guarantee is made for availability of equipment, no formal contract is entered into until the equipment is delivered or collected and signed for by the hirer, or appropriate party acting on behalf of the hirer.
- Van Mildert College Junior Common Room reserves the right to cancel any hire without warning without compensation
- Any late cancellation of the reserved equipment by the customer may incur a charge for lost revenue
- If all or any of the Equipment is not returned on the expiry of the hire, the "End of the Hire Period", the Hirer will be required to pay for the continued use of the equipment an amount equal to the hire cost for each day that the equipment is not returned or otherwise unaccounted for.
- No condition, warranty, representation or stipulation of any kind has been made by or on behalf of the Junior Common Room of Van Mildert College in respect of the Equipment
- The hirer will be deemed to have satisfied themselves as to the condition, quality, description and all other aspects of the Equipment, including all warranties, conditions and stipulations express relating to the condition of the Equipment or its quality or suitability or fitness for the particular or any purpose for which it may be required.
- The Junior Common Room of Van Mildert College will not be liable in contract or in any other way for any consequential or indirect loss, liability or damage or for any other claim for consequential compensation whatsoever arising howsoever in connection with this hire, to the maximum extent permitted by law.
